Copyright Policy & DMCA Procedure

1. Copyright Principles

NiaTube is committed to protecting original creative work while supporting lawful expression, education, journalism, cultural preservation, commentary, and innovation.

Creators retain ownership of the original content they produce, subject to the licenses and permissions granted under the NiaTube Terms of Service and any applicable creator agreements.

Users may upload, publish, stream, or share content only where they own the necessary rights, have received appropriate permission, or are otherwise legally authorized to use the material.

NiaTube may consider applicable limitations and exceptions to copyright, including fair use, fair dealing, quotation, criticism, review, reporting, education, parody, and other lawful uses recognized in relevant jurisdictions.

2. Respecting Intellectual Property

All users are responsible for ensuring that the content they upload, publish, stream, distribute, or otherwise make available through NiaTube does not infringe the intellectual property rights of others.

Copyright-protected material may include videos, music, sound recordings, films, photographs, artwork, written works, broadcasts, software, graphics, performances, and other original creative expression.

Users should:

• Upload only content they created, licensed, received permission to use, or are otherwise legally authorized to publish.
• Obtain any necessary rights for music, images, clips, performances, broadcasts, and other third-party material included in their content.
• Provide attribution where required by a license, agreement, or applicable law.
• Keep reasonable records of permissions, licenses, contracts, and other evidence supporting their right to use protected material.
• Respect trademarks, publicity rights, privacy rights, and other legal rights in addition to copyright.

Giving credit to a copyright owner does not by itself create permission to use protected material. Similarly, purchasing or downloading a copy of a work does not necessarily grant the right to reproduce, distribute, publicly perform, or upload that work.

3. Reporting Copyright Infringement

Copyright owners, authorized representatives, and other eligible rights holders may submit a copyright complaint if they believe content available on NiaTube infringes their rights.

A copyright complaint should identify the protected work, identify the content alleged to be infringing, and provide enough information for NiaTube to locate and review the material.

A complete report should include:

• The full legal name and contact information of the copyright owner or authorized representative.
• A description of the copyrighted work or works claimed to have been infringed.
• The URL, content identifier, channel name, or other information sufficient to locate the allegedly infringing material.
• A statement explaining why the reporting party believes the use is not authorized by the copyright owner, its agent, or applicable law.

• A physical or electronic signature where required by applicable law.

Incomplete, unclear, or unsupported reports may delay review. NiaTube may request additional information before taking action.

4. DMCA Notice Procedure

Where applicable, NiaTube responds to copyright notices submitted under the United States Digital Millennium Copyright Act (DMCA) and may also process similar notices under other applicable copyright laws. Valid notices are reviewed in accordance with applicable legal requirements and Platform policies.

Upon receiving a facially valid notice, NiaTube may remove or disable access to the identified content, notify the affected user, preserve relevant records, and take any additional action required by law or reasonably necessary to protect the rights of copyright owners and Platform users.

A DMCA Notice should generally include:

• Identification of the copyrighted work claimed to have been infringed.
• Identification of the allegedly infringing material and information sufficient to locate it on the Platform.
• Contact information for the complaining party.
• A statement of good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notice is accurate and, where required, made under penalty of perjury.
• A physical or electronic signature of the copyright owner or an authorized representative.

5. Counter-Notification Procedure

If content has been removed or disabled following a copyright complaint, the affected user may be entitled to submit a counter-notification where permitted by applicable law.

A counter-notification should explain why the user believes the content was removed in error or why they are legally authorized to use the material. NiaTube may request additional information where reasonably necessary to evaluate the submission.

A counter-notification should generally include:

• Identification of the removed or disabled content.
• A statement explaining the legal basis for restoring the content, such as ownership, permission, license, fair use, fair dealing, or another applicable legal exception.
• Current contact information for the submitting party.
• Any declarations required under applicable law.
• A physical or electronic signature where required.

Upon receiving a valid counter-notification, NiaTube may review the submission, notify the original complainant where required, and restore content if appropriate and consistent with applicable law.

6. Repeat Infringer Policy

NiaTube is committed to protecting intellectual property rights while providing users with fair opportunities to resolve copyright disputes. Users who repeatedly infringe the copyrights of others may be subject to escalating enforcement actions.

In determining whether a user is a repeat infringer, NiaTube may consider the number of valid copyright complaints received, the severity and nature of the conduct, prior enforcement history, counter-notifications, legal outcomes, and other relevant circumstances.

Possible Enforcement Measures

• Educational notices and policy reminders.
• Warnings for first or less serious violations.
• Removal or restriction of infringing content.
• Temporary suspension of upload or monetization privileges.
• Temporary account suspension.
• Permanent account termination for repeated or serious infringement.

NiaTube may also take immediate action where required by applicable law, court order, settlement agreement, or other legal obligation.

7. Misuse of Copyright Claims

Copyright reporting tools must be used honestly and responsibly. Submitting false, misleading, abusive, or bad-faith copyright claims may harm creators, interfere with lawful expression, and undermine the integrity of the Platform.

Users should not submit copyright complaints where they do not own the relevant rights, are not authorized to act for the rights holder, or know that the challenged use is lawful.

Misuse may include:

• Submitting claims intended to harass, intimidate, silence, or retaliate against another user.
• Knowingly misrepresenting ownership or authorization to act on behalf of a copyright owner.
• Repeatedly submitting unsupported or clearly invalid complaints.
• Using copyright procedures to target criticism, commentary, parody, journalism, education, or other potentially lawful uses without a reasonable legal basis.
• Providing false statements, fabricated evidence, or misleading information in a notice or counter-notification.

NiaTube may reject abusive submissions, restrict access to reporting tools, suspend accounts, preserve relevant records, or take other appropriate action where misuse is identified.

8. Policy Updates

NiaTube may update this Copyright Policy & DMCA Procedure from time to time to reflect changes in applicable law, court decisions, technology, Platform features, creator tools, business operations, industry practices, or regulatory requirements.

When material changes are made, NiaTube may provide notice through the Platform, by email, or through other reasonable communication channels, where appropriate. The updated Policy becomes effective on the date identified in the revised version unless otherwise required by applicable law.

Rights holders, creators, and users are encouraged to review this Policy periodically so they remain informed about the copyright procedures that apply when using the Platform.

NiaTube welcomes copyright-related questions, notices, counter-notifications, and other intellectual property inquiries. Rights holders, creators, users, and authorized representatives may contact NiaTube through the official support channels published on the Platform.

As NiaTube grows, additional reporting channels, copyright management tools, and rights-holder resources may be introduced to improve the efficiency, transparency, and fairness of the Platform's intellectual property processes.
