3. Acceptable Use

NiaTube is built to support creativity, education, culture, journalism, entrepreneurship, entertainment, and meaningful community engagement. You agree to use the Platform in a lawful, respectful, and responsible manner.

You may not use NiaTube to engage in activity that harms users, creators, communities, the Platform, payment systems, or the integrity of the NiaTube ecosystem.

• Use the Platform for unlawful, fraudulent, or deceptive purposes.
• Impersonate another person, creator, business, or organization.
• Upload or distribute content that infringes intellectual property rights.
• Harass, threaten, exploit, abuse, or intimidate other users.
• Artificially manipulate views, likes, comments, subscriptions, payments, or monetization activity.
• Attempt to bypass security, payment, identity, moderation, or compliance systems.
• Distribute malware, harmful code, spam, scams, or misleading content.
• Use the Platform in a way that violates sanctions, financial regulations, or applicable law.

4. User Content

NiaTube enables users to publish, upload, stream, comment on, and share content with the community. You retain ownership of the content that you create and upload, subject to the rights granted under these Terms.

By submitting content to the Platform, you represent that you own the necessary rights or have obtained all required permissions to publish that content. You are responsible for ensuring that your content does not violate the intellectual property, privacy, publicity, or other legal rights of any person or organization.

By uploading content to NiaTube, you grant NiaTube a non-exclusive, worldwide, royalty-free license to host, process, store, reproduce, display, distribute, and make your content available solely for the purpose of operating, improving, promoting, securing, and providing the Platform and its services.

This license does not transfer ownership of your content to NiaTube. Except as permitted by these Terms or applicable law, creators remain the owners of the original content they publish on the Platform.

5. Creator Responsibilities

NiaTube is committed to empowering creators through technology, transparent monetization, and responsible governance. Creators who publish content on the Platform play an essential role in maintaining a trusted and inclusive community.

As a creator, you agree to publish content responsibly, respect the rights of others, and comply with these Terms, the Community Guidelines, and all applicable laws and regulations.

• Provide accurate and truthful account information.
• Publish only content that you own or are authorized to use.
• Respect copyrights, trademarks, privacy rights, and other intellectual property.
• Avoid misleading, fraudulent, deceptive, or harmful conduct.
• Cooperate with reasonable compliance, moderation, and security reviews.
• Maintain the integrity of the NiaTube creator ecosystem.

Creators who choose to participate in monetization programs, memberships, Super Support, advertising, wallet services, payouts, or other financial products may be required to satisfy additional eligibility, identity verification (KYC), tax, compliance, or policy requirements.

Participation in creator monetization programs is also governed by the Creator Monetization & Payout Terms and other applicable NiaTube financial policies. Those documents provide the authoritative rules governing creator earnings, payouts, wallet balances, settlements, and related financial services.

6. Monetization Overview

NiaTube offers eligible creators opportunities to earn revenue through creator monetization programs made available on the Platform. These opportunities are intended to help creators build sustainable businesses while providing audiences with meaningful ways to support the content they value.

Available monetization features may include, but are not limited to, advertising revenue, channel memberships, Super Support, viewer tips, sponsorship tools, digital products, subscriptions, and other creator economy services introduced by NiaTube from time to time.

Participation in monetization programs is subject to eligibility requirements, verification procedures, compliance reviews, applicable laws, and acceptance of additional NiaTube policies governing financial services.

Creator earnings may be received in one or more supported currencies, depending on the source of the revenue. NiaTube maintains creator wallet balances and settlement records in accordance with the Platform's financial policies.

Detailed rules governing creator eligibility, earnings, platform fees, payout schedules, wallet balances, settlement calculations, currency conversion, withdrawals, tax obligations, and payment processing are contained in the Creator Monetization & Payout Terms and related financial policies, which are incorporated into these Terms by reference for creators who participate in monetization programs.

7. Intellectual Property

Respect for intellectual property is fundamental to the NiaTube community. Creators retain ownership of the original content they create and publish, subject to the rights granted to NiaTube under these Terms for the operation of the Platform.

Except where otherwise stated, the NiaTube name, logo, software, platform design, trademarks, service marks, documentation, technology, and other proprietary materials are owned by or licensed to NiaTube and are protected by applicable intellectual property laws.

Users may not copy, reproduce, distribute, modify, reverse engineer, or commercially exploit any portion of the Platform except where expressly permitted by applicable law or with prior written authorization from NiaTube.

If you believe that content published on the Platform infringes your intellectual property rights, you may notify NiaTube using the official reporting channels. NiaTube will review such reports and take appropriate action consistent with applicable law and our published policies.

8. Governance as a Foundational Pillar

Governance is not a layer added to NiaTube after the Platform was built. It is one of the Platform's foundational pillars, evolving alongside its technology, financial systems, creator economy, and community.

NiaTube's governance framework is designed to support responsible platform operations, transparent creator monetization, financial accountability, content integrity, community trust, and long-term sustainability.

This governance framework may include policies, procedures, review systems, compliance controls, moderation standards, payment safeguards, eligibility rules, risk management processes, and other operational measures designed to protect the Platform and its users.

NiaTube may update, refine, or expand its governance systems over time as the Platform grows, new products are introduced, markets evolve, regulatory requirements change, or community needs develop.

9. Platform Services and Future Features

NiaTube continuously develops new products, services, and features to strengthen the creator economy and improve the experience of creators, viewers, advertisers, partners, and the broader community. Platform services may evolve over time as technology advances and user needs change.

Current and future Platform services may include creator monetization, memberships, livestreaming, digital commerce, advertising solutions, creator wallets, payment services, artificial intelligence features, financial intelligence, educational tools, business services, and other products introduced by NiaTube.

Certain features may be available only in selected countries, to eligible users, or subject to additional verification, regulatory requirements, technical limitations, or separate agreements. NiaTube may introduce, modify, suspend, or discontinue features as the Platform continues to evolve.

Unless expressly stated otherwise, the introduction of new Platform features does not modify these Terms. Additional product-specific terms may apply where appropriate and will supplement these Terms for the relevant service.

10. Changes to These Terms

NiaTube may revise these Terms of Service from time to time to reflect changes in applicable law, regulatory requirements, Platform features, technology, business operations, security practices, or governance policies.

When material changes are made, NiaTube may provide notice through the Platform, by email, or through other reasonable communication channels, as appropriate. The revised Terms will become effective on the date specified in the updated version unless otherwise required by applicable law.

Your continued access to or use of the Platform after revised Terms become effective constitutes your acceptance of those updated Terms. If you do not agree to the revised Terms, you should discontinue your use of the Platform.

11. Termination & Account Suspension

NiaTube strives to maintain a trusted, secure, and respectful environment for creators, viewers, advertisers, partners, and the broader community. To protect the integrity of the Platform, NiaTube reserves the right to suspend, restrict, or terminate access to all or part of the Platform where reasonably necessary.

Account suspension or termination may occur where a user materially violates these Terms, applicable laws, Community Guidelines, creator-specific agreements, financial policies, or engages in fraudulent, abusive, deceptive, or unlawful conduct that presents a risk to the Platform or its users.

Where appropriate and consistent with applicable law, NiaTube may provide notice or an opportunity to address a violation before taking enforcement action. However, immediate suspension or termination may occur where necessary to protect users, safeguard Platform security, comply with legal obligations, or prevent fraud or other significant harm.

Users may discontinue their use of the Platform at any time by closing their account. Certain rights, responsibilities, payment obligations, intellectual property provisions, and other sections of these Terms that by their nature should survive termination will remain in effect after an account is closed.

12. Disclaimers

NiaTube provides the Platform and its services on an "as is" and "as available" basis, subject to applicable law. While NiaTube works to maintain a reliable, secure, and high-quality Platform, we do not guarantee that every feature will always be available, uninterrupted, error-free, or free from technical limitations.

Content published on the Platform is created by users, creators, advertisers, partners, and other third parties. Unless expressly stated otherwise, NiaTube does not endorse, verify, or guarantee the accuracy, reliability, legality, completeness, or quality of third-party content.

Users are responsible for evaluating the information, products, services, and opportunities they encounter through the Platform and for making their own independent decisions before relying on or acting upon them.

To the maximum extent permitted by applicable law, NiaTube disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, security, and accuracy.

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited under applicable law.

13. Limitation of Liability

To the maximum extent permitted by applicable law, NiaTube, its affiliates, officers, directors, employees, contractors, licensors, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your access to or use of the Platform.

This limitation applies whether the claim is based on contract, tort, negligence, strict liability, statute, or any other legal theory, even if NiaTube has been advised of the possibility of such damages.

Except where prohibited by applicable law, NiaTube's total aggregate liability arising out of or relating to these Terms or your use of the Platform shall not exceed the greater of the amount you paid to NiaTube during the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred United States dollars (US $100).

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited under applicable law.

14. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless NiaTube, its affiliates, officers, directors, employees, contractors, licensors, and partners from and against claims, liabilities, damages, losses, costs, and reasonable legal expenses arising out of or relating to your use of the Platform, your content, your violation of these Terms, or your infringement of the rights of any person or organization.

This obligation applies only to the extent that the claim results from your actions, omissions, or breach of these Terms and does not apply where the claim arises solely from NiaTube's own misconduct or where indemnification is prohibited by applicable law.

NiaTube reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification. In such circumstances, you agree to cooperate reasonably with NiaTube in the defense of the matter.

15. Governing Law

These Terms and any dispute arising out of or relating to the Platform, your use of the Platform, or your relationship with NiaTube will be governed by the laws applicable to the NiaTube legal entity identified in the official legal notices published on the Platform, without regard to conflict-of-law principles.

Where applicable law gives you mandatory rights or protections in your country or region of residence, nothing in these Terms is intended to limit or exclude those rights.

Any dispute that cannot be resolved informally will be handled in accordance with the dispute-resolution procedures, venue requirements, and jurisdictional rules published by NiaTube and permitted under applicable law.

16. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court or other authority with jurisdiction, that provision will be interpreted, modified, or limited to the minimum extent necessary to make it enforceable where permitted by law.

If the affected provision cannot be made enforceable, it will be severed from these Terms without affecting the validity or enforceability of the remaining provisions.

The remaining provisions of these Terms will continue in full force and effect to the greatest extent permitted by applicable law.

17. Entire Agreement

These Terms, together with the Privacy Policy, Community Guidelines, and any additional agreements or policies that apply to specific NiaTube products or services, constitute the entire agreement between you and NiaTube regarding your use of the Platform.

These Terms supersede any prior or contemporaneous understandings, communications, representations, or agreements relating to the same subject matter, whether written or oral, except where a separate written agreement expressly states that it overrides these Terms.

If a product-specific agreement applies to a particular service, that agreement supplements these Terms and will govern that service to the extent of any direct inconsistency.

NiaTube may update its contact information from time to time. The most current contact details published on the Platform will govern for purposes of official communications.
